there is really no one act you can point to as the handing over the constitution. the constitution's demise is more of a decay that has occurring slowly but steadily since its inception. This decay really picked up speed starting after the new deal, FDR threatening the court and the rapid expansion of federal power.  The Supreme Court has never been the same since the "great" FDR strongarmed them.
