While the Federal Circuit denied a broad delay, the administration could request targeted extensions or phased implementation from the CIT, arguing administrative complexity (e.g., updating systems or calculating refunds for thousands of importers). However, the CIT may be inclined to move quickly given the higher courts’ directives.
  3. The administration could file a petition for rehearing or reconsideration with the Supreme Court, as President Trump has publicly suggested on social media. This is a long shot—rehearings are granted in fewer than 1% of cases and typically only for clear errors or new evidence. It wouldn’t automatically stay proceedings.
  4.  Push Congress to pass laws retroactively authorizing similar tariffs, limiting refunds, or providing new authority for trade measures.
