- While the immunity questions will likely return to the Supreme Court after the D.C. Circuit weighs in on the issues, before then the justices will consider the validity of two of the four charges levied against the former president — and it is likely a majority of the Supreme Court will rule that the “crimes” the special counsel charged are not crimes at all. - Smith charged Trump in a four-count indictment in a federal court in D.C., seeking to hold the former president and 2024 GOP front-runner criminally responsible for the events of Jan. 6, 2021. Specifically, the indictment charged Trump with conspiracy to defraud the United States, conspiracy against rights, conspiracy to obstruct an official proceeding, and obstruction of and attempt to obstruct an official proceeding.
- While all four theories of criminal liability are weak, the Supreme Court will soon decide whether the events of Jan. 6 qualify as criminal obstruction of an official proceeding under Section 1512 of the federal criminal code in United States v. Fischer.
- Earlier this month, the Supreme Court agreed to hear Joseph Fischer’s appeal that presents the question of whether 18 U.S.C. § 1512(c) criminalizes acts unrelated to investigations and evidence that obstructs an “official proceeding.” Fischer, like Trump, was charged with violating § 1512(c) by engaging in conduct on Jan. 6 that obstructed the certification of the electoral vote.
- The question for the Supreme Court in the Fischer case is one of statutory interpretation. Thus to understand the issue requires a detailed study of the specific language of § 1512(c). That section, titled “Witness, Victim, or Informant Tampering,” provides:
- (c) Whoever corruptly — (1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or (2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so, shall be fined under this title or imprisoned not more than 20 years, or both.
- Fischer and Trump, as well as scores of other Jan. 6 defendants, were charged with violating subsection 2 of § 1512(c) by “otherwise” obstructing or impeding the certification of the electoral vote. In Fischer’s case, he asked the trial court to dismiss the § 1512(c) charge, arguing the statute only criminalized conduct that rendered evidence unavailable to an “official proceeding.” The district court agreed and dismissed the § 1512(c) count against Fischer.
- The government appealed to the D.C. Circuit Court of Appeals, which in a 2-1 decision reversed the lower court, with the two-judge majority holding that § 1512(c) criminalized any conduct that obstructed or impeded an official proceeding, whether that conduct impaired the availability of evidence or not, leading the Supreme Court to grant certiorari.While forecasting the outcome of an appeal from the Supreme Court always leaves room for error, for several reasons the high court seems likely to hold that § 1512(c) does not reach the conduct of Fischer, Trump, or other Jan. 6 defendants.

POLL: Trump Now Leading Biden With Young and Hispanic Voters
In the first poll of 2024, President Trump leads Joe Biden among Hispanics and young voters.
Trump also leads Joe Biden among Independent voters and is gaining support among black voters coming into the new year, spelling doom for Joe Biden and the Democrats.
These groups see where Biden is taking this country, and it’s not the right direction.
Additionally, Trump is beating Biden in seven key swing states.

The USA Today/Suffolk University survey found that 39 per cent of Hispanic voters now back the former president compared to 34 per cent supporting his Democratic successor.
Mr Trump also has a four percentage point lead among voters under 35, with 37 per cent to Mr Biden’s 33 per cent.
These demographics typically vote Democrat so the findings spell potential trouble for the incumbent going into the 2024 presidential race, even as his GOP rival faces a slew of criminal trials.
According to the Roper Center for Public Opinion Research at Cornell University, Biden won 65% of the Hispanic vote in 2020.
Biden is also losing the black voters, who supported him more than Hispanics in 2020.

He now has the support of just 63% of black voters, a group he carried by a whooping 87% in 2020.
Overall, the poll found that Trump in the lead at 39% to Biden’s 37% with 17% supporting an unnamed third-party candidate.
When third-party candidates were specified by name, Trump’s lead increased to 37% to Biden’s 34%, with independent candidate Robert F. Kennedy Jr. at the top of the third-party candidates at 10%.
The overall trend is worrisome for Biden, particularly with younger voters, who overwhelmingly supported him four years ago and are largely at odds with Republicans on issues such as abortion access and climate change.

Sun God — So where did the 25th of December celebration come from?
First of all – could Jesus have been born on that day? Most scholars agree that it is unlikely. In the gospel of Luke, the shepherds are mentioned watching over their flocks at night. This is considered highly unlikely as they would have kept them under cover in the freezing cold winter. Also, the Bible places Joseph and Mary in Bethlehem for the Roman census – but any census in the Roman Empire was never done in the winter because of the cold and the terrible state of the roads. So where did it come from then? Almost certainly from existing pagan celebrations. The winter solstice (shortest day) had always been celebrated by primitive peoples as the beginning of hope for the arrival of spring. This continued into classical times. The Romans celebrated the festival of Saturnalia between 17th and 25th December. It paid tribute to Saturn – the God of Agriculture and Harvest. There were sacrifices, banquets, gift giving and partying. Even the so called Barbarian tribes of Europe celebrated with midwinter festivals. However this became firmed up with the arrival of a new religion emerging in the Roman Empire from the first century CE onwards.
Christianity? No! The sun god Mithra had been worshipped in Persia from about the 6th century BCE. The Greeks adapted the name to Mithras and experts believe that Roman soldiers picked it up on campaigns in Persia. It became a hugely popular mystery religion across the whole Empire. It was celebrated almost exclusively by men who were soldiers. This of course explains why it never thrived totally unlike Christianity. It became associated with the Roman worship of the Sun and in 274CE the Emperor Aurelian established the birth of Sol Invictus (Unconquered Sun) on the 25th December.
When the Emperor, Constantine the Great, converted to Christianity in the early 4th century CE he had to try to convert an Empire full of pagans. The decision to celebrate the birth of Jesus on a date that was already sacred in pagan traditions made perfect sense. It was therefore decided that the birthday of the Sun God would also be the birthday of the Son of God! (why do you think that the most important church services are held on a SUNday?)
