 Will  President Trump might invoke the U.S. Constitution’s Guarantee Clause (Article IV, Section 4) to take direct action on election integrity. 
  • The Guarantee Clause states: “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”
  •  a “republican form of government” requires meaningful, honest elections based on majority rule. Rigged or fraudulent elections, in his view, fail this standard.
  • Historically and in Supreme Court precedent (e.g., Luther v. Borden), Guarantee Clause issues have been treated as non-justiciable political questions — meaning courts stay out and leave decisions to Congress and the President.
  • He suggests the President could act unilaterally under the clause (without needing new congressional legislation) by, for example, sending large numbers of federal election watchers to oversee voting and counting in areas with suspected fraud.
